Terms & Conditions

These Terms & Conditions apply to assessment services provided by LevelCheck Pty Ltd trading as LevelCheck (ABN 32 692 039 642).

By booking or engaging LevelCheck, you agree to these Terms & Conditions.

1. Our services

LevelCheck provides independent foundation movement assessments, floor-level assessments and related advisory services.

Our role is to provide practical, independent information based on the conditions we can observe and our industry experience.

LevelCheck does not provide structural engineering, geotechnical engineering, building inspection certification or engineering design unless expressly stated otherwise.

Our assessments and reports do not replace specialist engineering, geotechnical or building advice where that type of professional service is required.

2. Further investigation and referrals

If we believe further investigation may be appropriate, we may recommend that you speak with a structural engineer, geotechnical engineer, building inspector, plumber, contractor or other relevant professional.

You are free to choose whether to obtain further advice and which professional or contractor you engage.

Any third party you engage provides their services independently of LevelCheck, and LevelCheck is not responsible for their advice, work or charges.

3. Payment

On-site assessments

A $99 deposit is required when booking an on-site assessment.

The remaining assessment fee is payable before the written report is released.

We may withhold the written report until the assessment fee has been paid in full.

Virtual assessments

Virtual assessments are payable in full at the time of booking.

Assessment work may not commence until payment has been received.

Overdue payments

If an amount remains unpaid when due, we may withhold the report or other outstanding deliverables until payment is received.

We may charge interest on overdue amounts at 8% per annum, calculated daily, where permitted by law.

4. Cancellations and rescheduling

We ask for at least 24 hours' notice if you need to cancel or reschedule an assessment.

Where less than 24 hours' notice is provided, a cancellation fee of up to 50% of the quoted assessment fee may apply, having regard to the circumstances and costs reasonably incurred by LevelCheck.

If our assessor attends the property and the assessment cannot reasonably proceed because access has not been provided, pets have not been secured, hazards have not been disclosed or the site is otherwise inaccessible or unsafe, an attendance or call-out fee may apply.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

5. What our assessments cover

Our assessments are based on the conditions that are reasonably observable and accessible at the time of the assessment.

Unless specifically agreed otherwise, we do not:

  • carry out destructive testing

  • inspect concealed or inaccessible areas

  • guarantee the future performance of a building, foundation, structure or soil

  • provide structural engineering certification

  • provide building compliance certification.

Conditions can change after an assessment. Our findings relate to the information and conditions available to us at the time.

6. Your responsibilities

To help us carry out the assessment properly, you agree to:

  • provide reasonable and safe access to the property

  • secure pets

  • tell us about known hazards or access restrictions

  • provide relevant information you hold about the property

  • understand that our assessment has the scope and limitations described in these Terms.

If we recommend further specialist investigation, it is your decision whether to obtain that advice.

7. Independent advice

LevelCheck does not carry out foundation repair work and does not receive commissions, referral fees or incentives from contractors for repair work.

Our role is to provide independent assessment and practical guidance.

Any contractor or professional we mention is optional, and you remain free to engage any provider you choose.

8. Reports and intellectual property

LevelCheck retains ownership of the intellectual property in its reports, photographs, diagrams and other assessment material.

You may use and share your LevelCheck report for reasonable purposes relating to the property that was assessed, including discussing it with relevant advisers, contractors, insurers, purchasers or professionals.

The report must not be altered or presented in a misleading way.

A report relates only to the property and assessment for which it was prepared and should not be relied upon as an assessment of another property.

Third parties considering a LevelCheck report should take into account its purpose, date, scope and limitations and obtain their own professional advice where appropriate.

9. Liability and Australian Consumer Law

To the extent permitted by law, LevelCheck is not responsible for loss arising solely from:

  • conditions that changed after the assessment

  • concealed or latent defects that could not reasonably be identified through the agreed non-invasive assessment

  • areas that were inaccessible or unsafe to inspect

  • a decision not to obtain further specialist advice where that advice was recommended.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

10. Concerns and complaints

If you have a concern about our assessment or report, please contact us as soon as reasonably possible so we have an opportunity to review the issue.

Where a matter cannot be resolved directly, you may have the right to seek assistance from Consumer Affairs Victoria or another relevant authority.

11. Governing law

These Terms & Conditions are governed by the laws of Victoria, Australia.
